1. Parties to the Agreement

1.1 These Terms and Conditions (the “Terms”) govern the use of the online service (the “Service”) operated by Tyyni Puzzles Oy. Any individual or organization (the “User”) who registers an account or places an order through the Service agrees to comply with these Terms. 

1.2 Our store is hosted by Shopify Inc. and they provide the e-commerce platform that enables us to sell our products to you. 

2. Use of the Service

2.1 The Service may be used by private individuals who are 18 or older and by organizations and institutions.

2.2 Our products may not be used for any illegal or unauthorized purpose and you may not violate any laws in your jurisdiction (including copyright laws) in the use of the Service. 

2.3 A breach or violation of the Terms will result in an immediate termination of your Service.

2.4 Business and institutional customers are not eligible for consumer-level return rights.

2.5 All material available through the Service—such as images, text, graphics, and other content—is protected by applicable intellectual property laws. The User is granted a limited, personal right to access the Service. Reproduction, modification, distribution, or other unauthorized use of the content is prohibited without prior written permission from Tyyni Puzzles Oy.

3. Registration

3.1 Creating an account requires completing the registration form and choosing login credentials. User must provide accurate contact details, and business customers must also provide required company identification numbers. Registration is free of charge.

3.2 By registering, the User confirms that they have read and accepted these Terms.

3.3 A person placing an order on behalf of a company confirms that they have the authority to bind that company to these Terms.

4. User Responsibilities

4.1 The User is responsible for all actions carried out using their account and must ensure that login credentials remain confidential.

4.2 The User must ensure that all information provided to the Service is correct and up to date.

5. Privacy

5.1 Tyyni Puzzles Oy processes personal data in accordance with applicable data protection laws, including EU data protection regulations. 

5.2 Details about data processing are provided in the separate Privacy Policy.

6. Ordering and Payment

6.1 A binding agreement between the User and us is formed once the User receives an order confirmation email indicating product availability and an estimated delivery schedule.

6.2 Unless otherwise mutually agreed in writing, Tyyni Puzzles Oy must receive payment before an order can be accepted.

6.3 We may decline an order at our sole discretion.

7. Prices

7.1 The price of a product is the one displayed on the Service at the moment the order is placed. Prices include applicable value-added tax (VAT). Shipping fees vary by destination and are shown during checkout.

7.2 Prices are shown in the currency assigned to the delivery country.

8. Delivery

8.1 Products are only delivered within European Union unless otherwise specifically mutually agreed upon. Delivery costs depend on the shipping destination and are shown prior to order confirmation.

8.2 Delivery times vary according to product availability and destination.

8.3 Tyyni Puzzles Oy is not liable for delays or failures caused by events outside its reasonable control, such as natural disasters, strikes, or disruptions in transportation or communication networks.

8.4 We assume responsibility for loss or damage to products that occurs during shipping.

9. Cancellations and Returns

9.1 Consumers (excluding business and institutional buyers) may return or exchange products within 30 days, provided that the items are unused, in original condition, complete, and repackaged appropriately. Customized or made-to-order products cannot be returned.

9.2 For returns, please contact us at hello@tyynipuzzles.com for further instructions. 

9.3 Returned products must be shipped promptly after cancellation. The User bears the direct costs for returning the products. 

9.4 The User bears responsibility for the item until it has been received back by Tyyni Puzzles Oy or its service provider.

9.5 Returns may be subject to a restocking fee, which varies by region and product type and will be deducted from the refund amount.

9.6 If the entire order is returned, the initial shipping fee is refunded. 

9.7 Returns due to defects are free of charge.

10. User generated content

10.1 Tyyni Puzzles Oy engages with its customers and social media users. If you post content on our social media channels when taking part in a contest or giveaway or by responding to our request with #tyynipuzzles or if you without request send us creative ideas, suggestions or proposals or other similar material, you grant us a free license to use, edit, copy, publish, distribute, translate and otherwise use your content, in our advertising and other marketing activities.

10.2 You confirm that your content will not violate any right of any third-party, including but not limited to copyright, trademark, privacy or other personal or proprietary right.  We assume no liability in respect of your content and you agree to indemnify us against any liability arising therefrom. 

11. Limitation of liability

11.1 To the largest extent permitted by mandatory applicable laws, Tyyni Puzzles Oy, its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors shall not be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including but not limited to lost profits, lost revenue, lost savings, loss of date or other similar damages. 

12. Changes to the Service and Terms

12.1 Tyyni Puzzles Oy may update or modify the Service or these Terms at any time.

13. Governing Law and Dispute Resolution

13.1 These Terms are governed by the laws of Finland. Disputes should first be settled amicably and if no resolution is reached, they will be handled by the District Court of Helsinki, Finland.

14. Entire agreement and severability

14.1 These Terms and any other terms and policies posted by Tyyni Puzzles Oy on this site in respect of the Service shall constitute the entire agreement between you and Tyyni Puzzles Oy.

14.2 In the event that any provision of these Terms is unlawful, void or unenforceable, such provision shall be enforceable to the fullest extent permitted by law and the any other remaining provisions and their validity and enforceability shall not be affected. 

14.3 In the event Tyyni Puzzles Oy fails to exercise or enforce any of its right or provision of the Terms, this shall not constitute a waiver of such right or provision.
